Your use of this website is operated by Edutive LLC dba CONDUCTR ("CONDUCTR," "Company," "we," "our," or "us"). These Terms of Service (the "Terms") govern your access to and use of iamconductr.com, related sub-domains, mobile applications, digital products, coaching programs, live events, and any services we provide (collectively, the "Services"). Please read these Terms carefully because they form a legally binding agreement between you and CONDUCTR. By accessing or using any of the Services, you agree to be bound by these Terms and our Privacy Policy.

The Company provides mental performance coaching, educational content, and personal development programs for adults and youth ages 10 through 17. We are not a medical, psychological, or legal service provider. All content is for informational and educational purposes only.
We may update these Terms at any time by posting a revised version on the Site and updating the "Last updated" date. Continued use of the Services after changes become effective constitutes your acceptance of the revised Terms.
You may use the Services only if you (a) can form a binding contract with us, (b) are not barred from using the Services under applicable law, and (c) will comply with these Terms and all applicable laws and regulations. Parents or legal guardians registering minor participants represent and warrant that they have full legal authority to bind the minor and to act on their behalf in connection with the Services.
You may need to create an account to access certain Services. You must provide accurate information and keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use.
All coaching sessions, including individual 1:1 sessions and group calls, are recorded. Recordings are made for purposes of accuracy, coaching quality, and the mutual protection of all parties. By enrolling in and participating in any live session, you expressly consent to being recorded. Because recording is integral to these coaching Services, participants who do not consent to recording may not be able to participate in certain sessions or programs that require recording as part of the Services.
For participants under 18, the parent or legal guardian's agreement to these Terms constitutes consent to recording on behalf of the minor. For participants under 13, a separate verifiable parental consent process will be completed at enrollment in accordance with COPPA requirements. Parents or legal guardians of participants under 13 may revoke consent prospectively at any time by contacting us, though revocation may limit the minor's ability to participate in recording-enabled Services.
Recordings remain the sole property of CONDUCTR and will not be shared with third parties except as described in our Privacy Policy or as required by law. Recordings may be processed, stored, or transmitted by third-party service providers acting on our behalf solely for operational, hosting, security, transcription, analytics, or coaching-support purposes, subject to appropriate confidentiality and security obligations.
We retain recordings for as long as reasonably necessary for the purposes described in these Terms and our Privacy Policy, including quality assurance, training, dispute resolution, legal compliance, safety, and operational needs, after which recordings are deleted or de-identified in accordance with our retention practices and applicable law.
Certain Services require payment. All prices are listed in U.S. dollars unless otherwise stated.
Adult 90-Day Coaching Program
The adult 90-day program is offered at the published rate at the time of enrollment. A full refund is available only if requested in writing within 24 hours following the completion of the first coaching session. After that window, all fees are final and non-refundable regardless of participation level or early discontinuation. By continuing past the first session without submitting a refund request, you acknowledge that you have had a meaningful opportunity to evaluate the program and agree to all remaining payment obligations.
Adult Monthly Subscription
Adult monthly subscriptions are billed on a recurring basis in advance unless cancelled. A full refund of the monthly fee is available only if requested in writing within 5 calendar days of the billing date. After day 5, the subscription may be cancelled to prevent future billing, but no refund will be issued for the current billing period. To cancel, submit a written cancellation request to [email protected] prior to your next billing date. Cancellation requests apply prospectively only and do not retroactively cancel or refund prior charges.
Youth 90-Day Program
The youth 90-day program is offered at the published rate at the time of enrollment. A full refund is available if requested in writing within 7 calendar days of the original purchase date. After 7 days, all fees are final and non-refundable regardless of participation level or early discontinuation. To cancel enrollment after the refund period, submit a written request to [email protected]. No refund will be issued for cancellations made after the 7-day refund window.
Youth Monthly Subscription
Youth monthly subscriptions are billed on a recurring basis in advance unless cancelled by the parent or legal guardian responsible for the account. A full refund of the monthly fee is available only if requested in writing within 5 calendar days of the billing date. After day 5, the subscription may be cancelled to prevent future billing, but no refund will be issued for the current billing period. To cancel, submit a written cancellation request to [email protected] prior to your next billing date. Cancellation requests apply prospectively only and do not retroactively cancel or refund prior charges.
General Refund Terms
All refund requests must be submitted in writing to [email protected]. Approved refunds are issued to the original payment method only. Taxes, foreign transaction fees, and payment processor fees are non-refundable. We reserve the right to update pricing, fees, and refund terms at any time upon reasonable prior notice where required by law. Any such changes will apply prospectively only. Continued use of the Services constitutes acceptance of the current terms. If a payment method cannot be successfully charged, we reserve the right to suspend or terminate access to paid Services until payment is successfully processed. You are responsible for providing and maintaining accurate billing and payment information. Nothing in this Section limits any non-waivable consumer rights that may apply under applicable law.
Youth programs are designed for participants ages 10 through 17. All registration, payment, and agreement to these Terms must be completed by a parent or legal guardian on behalf of any participant under 18. By enrolling a minor, the parent or legal guardian:
For participants under 13, acceptance of these Terms does not satisfy the verifiable parental consent requirement under COPPA. A separate consent process will be completed at enrollment as required by applicable law.
Parents or legal guardians of participants under 13 have the right, subject to applicable law, to review the personal information collected from their child, request deletion of such information, refuse further collection or use of the child's information, and revoke consent previously provided. Requests relating to a child's information may be submitted using the contact information provided in our Privacy Policy.
CONDUCTR will not knowingly collect more personal information from children under 13 than is reasonably necessary to participate in the Services.
Separate terms governing institutional or school-based engagements will be provided under a distinct written agreement. Additional details regarding our privacy practices, categories of information collected, retention practices, security safeguards, and parental rights are described in our Privacy Policy.
Adult Participants
The Company may request permission to use an adult participant's name, image, likeness, voice, testimonial, or program results for marketing and promotional purposes. Such use requires a separate written consent agreement and will not occur without it. Consent may be withdrawn at any time by contacting [email protected].
Participants Under 18
CONDUCTR will not use the name, image, likeness, voice, testimonial, or program results of any participant under 18 for any marketing, promotional, or advertising purpose without a separate, explicit written consent form signed by the parent or legal guardian. Acceptance of these Terms does not constitute authorization for marketing use of a minor's likeness. A standalone minor marketing consent form will be provided at enrollment and must be signed separately.
All content included in the Services — including text, graphics, logos, videos, frameworks, protocols, session recordings, and program materials — is the property of the Company or licensed to us and is protected by U.S. and international intellectual property laws. You may not copy, modify, distribute, or create derivative works from any such content without our prior written consent.
You retain ownership of any content you submit ("User Content"). By submitting User Content, you grant CONDUCTR a worldwide, royalty-free, sublicensable license to use, display, reproduce, distribute, and create derivative works from your User Content solely as reasonably necessary to provide, maintain, secure, support, improve, and administer the Services and related operations. You represent that you have all rights necessary to grant this license and that your User Content does not violate any third-party rights. CONDUCTR will not use User Content submitted by participants under 18 for advertising, marketing, or promotional purposes without separate express written consent from the participant's parent or legal guardian.

Our content and coaching are for educational and personal development purposes only and do not constitute medical, psychological, financial, or legal advice. We do not diagnose, treat, cure, or prevent any disease or condition. Always consult a qualified professional for personalized advice. Your reliance on any information provided through the Services is solely at your own risk.
We strive to provide high-quality coaching and content, but we make no representations or warranties regarding (a) the accuracy, completeness, or reliability of any content; (b) specific outcomes or results; or (c) uninterrupted or error-free access to the Services. The Services are provided "AS IS" and "AS AVAILABLE." To the fullest extent permitted by law, we disclaim all warranties, express or implied.
The Services may contain links to third-party websites or services that we do not control. We are not responsible for the content, policies, or practices of any third parties. Your dealings with third-party sites are solely between you and the third party.
You agree to indemnify, defend, and hold harmless the Company, its affiliates, officers, directors, employees, contractors, and agents from any claims, damages, liabilities, and expenses (including attorneys' fees) arising out of or related to your (a) use of the Services, (b) violation of these Terms, or (c) violation of any rights of another.
To the fullest extent permitted by law, in no event shall the Company, its affiliates, officers, directors, employees, or agents be liable to you for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, goodwill, or other intangible losses.
CONDUCTR shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from causes beyond CONDUCTR's reasonable control, including but not limited to acts of God, natural disasters, pandemics, government actions, war, civil unrest, power outages, internet or platform failures, or other events of a similar nature. In such circumstances, CONDUCTR will make reasonable efforts to resume performance as soon as reasonably practicable and will notify affected participants as soon as reasonably practicable.
We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, all provisions that by their nature should survive will survive, including intellectual property rights, disclaimers, recording ownership, and limitation of liability. Session recordings involving a terminated participant will be retained in accordance with CONDUCTR's Privacy Policy.
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law principles. You consent to personal jurisdiction and venue in the state and federal courts located in Delaware.
Any dispute arising out of or relating to these Terms or the Services shall be resolved through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration shall take place in the State of Delaware. For participants under 18, the parent or legal guardian enrolling the participant agrees to this arbitration provision on behalf of themselves and, to the fullest extent permitted by applicable law, on behalf of the minor participant.
If you access the Services from outside the United States, you are responsible for compliance with local laws. We make no representation that the Services are appropriate or available in other jurisdictions.
You consent to receive communications from us electronically, such as emails, texts, or notices posted on the Site. You agree that all agreements, notices, and disclosures we provide electronically satisfy any legal requirement that such communications be in writing.
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force. Our failure to enforce any right or provision is not a waiver. These Terms constitute the entire agreement between you and us regarding the Services and supersede any prior agreements.
